These Terms of Use govern the use of the WACUSA app, its resources, information, tools, calculations, online services and features related to aviation navigation, flight planning, location, radar, aeronautical data consultation, and weight and balance.
By using WACUSA, you declare that you have read, understood and agree to these Terms of Use.
WACUSA is a support tool for aviation navigation and operational planning.
The app may offer features such as maps, charts, route planning, estimates, weather information, NOTAM, real-time location, radar, flight plan, alerts, fuel calculations, and weight and balance.
All information displayed by the app is auxiliary and informational in nature.
WACUSA does not replace pilot judgment, operational procedures, aircraft manuals, official aeronautical publications, official charts, applicable regulations, or guidance from aeronautical authorities.
The user is responsible for verifying the accuracy, currency and suitability of all information used before, during and after the flight.
The pilot in command remains fully responsible for the safe operation of the aircraft, operational decision-making, compliance with air traffic rules, and observance of the aircraft operating limits.
The user must always consult official sources, aircraft documentation, valid aeronautical publications and applicable regulations before making decisions related to flight operations.
The Weight and Balance feature in WACUSA is intended exclusively for auxiliary and informational purposes.
Calculations involving weight, moment, center of gravity, fuel, CG envelope, station limits, ramp weight, takeoff weight, landing weight and zero fuel weight depend directly on the data entered by the user.
The user is responsible for correctly entering, among other data:
WACUSA does not guarantee the accuracy of the data entered by the user, generated calculations, registered envelopes or operational suitability of the aircraft for any specific flight.
The pilot in command and the aircraft operator remain fully responsible for checking the data used, validating the results obtained, and complying with the operating limits established by the manufacturer and the competent aeronautical authorities.
PROTOHM TECH LTDA is not responsible for operational decisions, damages, incidents, accidents, losses or consequences arising from the use of the app's Weight and Balance features.
Routes, distances, estimated times, fuel consumption, headings, speeds, levels, estimates and other calculations displayed by the app are provided as planning support.
This data may vary due to wind, actual aircraft performance, temperature, altitude, traffic, operational restrictions, route changes, air traffic control clearances and other factors.
The user must confirm all information before conducting the flight.
WACUSA may use device location data to display the user's position, record movement, calculate estimates, enable navigation resources and provide real-time location features.
When the user activates location sharing or real-time visibility features, certain information may be transmitted to WACUSA servers and displayed to other users or on public pages related to the feature.
This information may include, depending on the feature used:
The user is responsible for enabling or disabling these features according to their own decision and operational needs.
WACUSA must not be used as the sole source for separation, surveillance, traffic control, collision avoidance or official aircraft tracking.
The app may display or retrieve information from third parties, public agencies, external databases, map providers, weather services, aeronautical publications or other systems.
Although we seek to present useful and up-to-date information, we do not guarantee continuous availability, absence of errors, absolute accuracy or real-time updates for all data.
The user must confirm critical information through official sources before making operational decisions.
Some WACUSA features depend on an internet connection, our own servers, third-party services, GPS, device permissions, external data and technical infrastructure availability.
The app may experience interruptions, delays, failures, temporary unavailability, technical limitations or data discrepancies.
We do not guarantee that the service will be continuously available, uninterrupted, error-free or suitable for every operational situation.
The user agrees to use WACUSA lawfully, safely and consistently with its intended purpose.
It is prohibited to use the app for illegal, fraudulent or abusive purposes, to violate third-party rights, or to compromise the security of systems, servers, users or services.
It is also prohibited to attempt to access restricted areas, interfere with the app's operation, exploit vulnerabilities, perform unauthorized reverse engineering, or use the services in a way that harms other users.
Some features may require account creation, login or authentication.
The user is responsible for maintaining the confidentiality of their access credentials and for all activities performed through their account.
If unauthorized use is identified, the user must contact WACUSA support.
WACUSA may offer free and paid features, including subscriptions, in-app purchases or access plans.
Billing, renewal, cancellation and refund conditions may depend on the platform used, such as the App Store or Google Play.
The user must consult the rules of the respective store to manage subscriptions, cancellations and refund requests.
WACUSA, its brand, layout, code, features, texts, images, visual elements, database, information organization and other components belong to PROTOHM TECH LTDA or their respective licensors.
Use of the app does not grant the user any intellectual property rights over WACUSA or its components.
To the fullest extent permitted by applicable law, PROTOHM TECH LTDA will not be liable for direct, indirect, incidental, special, operational, material, moral, consequential damages, lost profits or any losses arising from the use of, or inability to use, the app.
This limitation includes, without limitation, decisions made based on maps, routes, estimates, weather, location, radar, alerts, calculations, weight and balance, aeronautical information or any other data displayed by WACUSA.
The user acknowledges that the final decision to start, continue, divert, modify or cancel a flight belongs exclusively to the pilot in command and those responsible for the operation.
These Terms of Use may be updated periodically to reflect changes in the app, legal requirements, security improvements or new features.
Relevant changes may be communicated through the app, by email or by other available means.
Continued use of WACUSA after the Terms are updated indicates acceptance of the new version.
The processing of personal data is governed by the WACUSA Privacy Policy .
By using the app, the user also declares that they are aware of and agree to the applicable Privacy Policy.
